
AI risks make some insurers wary of corporate liability
The RAND Corporation has released a report highlighting the growing mismatch between rapid enterprise AI adoption and the insurance industry's reluctance to cover associated liabilities. Insurers are increasingly adding exclusions for AI-related harms due to a lack of sufficient data to accurately price these emerging risks. This uncertainty may force the AI industry to moderate its ambitions and cause corporate customers to delay projects to fulfill fiduciary duties.
- ▪RAND's report notes that AI-related harms such as deepfakes and privacy violations do not fit neatly into existing insurance lines.
- ▪Insurer W. R. Berkley has introduced exclusions in its D&O, E&O, and Fiduciary Liability products to exclude coverage for any use of Artificial Intelligence.
- ▪Verisk/ISO introduced optional language in January 2026 allowing carriers to exclude harms arising from generative AI in over 80 percent of US property and casualty policies.
- ▪The Artificial Intelligence Incident Database currently lists 713 incidents of harm or near-harm caused by generative AI, with misinformation and manipulation being the most common category.
- ▪Approximately 250 US lawsuits related to AI are currently being tracked, largely stemming from the deployment of unreliable AI agents.
